FDA issued the proposed rule in 2013, and in 2014 we issued a supplemental proposal that included several changes in response to some of the more than 300 comments we received from stakeholders. After considering further comments, we published the final rule on November 27th of last year. ______________________ * * Before I delve into the details of the regulation I’d like to point out some very important themes. First, the regulation is structured to provide options for verification activities based on a number of factors including risk, and conformance with the preventive controls rule. Throughout the regulation the requirements for documentation are spelled out in detail. This is very important for the importer, as this documentation is intended to demonstrate that verification activities have been undertaken as appropriate. Even where there are modified requirments, there is a duty to maintain certain records.
