个人信用完善视角下的个人破产制度构建探究 摘要：破产法律制度是市场经济国家的标志，其中最为重要的便是个人破产法律制度。世界上实行市场经济的国家大多建立了个人破产制度，但我国立法并未把个人纳入破产主体范围，这不仅异于国际上通行做法，也悖于社会需求。目前我国破产的主体只包括企业法人，个人和其他经济主体还未纳入破产主体范围。我国关于个人破产立法还处于滞后阶段，是否构建个人破产法律制度、构建我国个人破产法律制度采取何种立法模式和个人破产法律制度的程序设置等问题还存有诸多争议，本文针对这些问题进行分析，正是本选题的理论意义所在。我国虽然没有制定个人破产法，但个人破产的现象在社会上大量的存在，个人破产不能通过破产程序解决债务问题，引发了一系列的消极社会影响，只有尽快把个人破产纳入立法，才能解决这些问题。本文通过对个人破产法律制度文献的研究分析，在综合国外立法经验的基础上，对我国个人破产法律制度的构建进行探析。 关键词：个人破产；自由财产；免责；失权；复权 Abstract Bankruptcy legal system is the symbol of market economy country, the most important of which is personal bankruptcy legal system. Most countries in the world have established individual bankruptcy system, but our legislation does not include individuals in the scope of bankruptcy subject, which is not only different from the international practice, but also contrary to social needs. At present, the subject of bankruptcy only includes enterprise legal person, individual and other economic subjects have not been included in the scope of bankruptcy subject. Chinas personal bankruptcy legislation is still in a backward stage. There are still many disputes on whether to build a personal bankruptcy legal system, what kind of legislative model to build a personal bankruptcy legal system and the procedural setting of the personal bankruptcy legal system. This paper analyzes these issues, which is the theoretical significance of this topic. Although there is no personal bankruptcy law in our country, the phenomenon of personal bankruptcy exists in a large number in the society. Personal bankruptcy can not solve the debt problem through the bankruptcy procedure, resulting in a series of negative social effects. Only by bringing personal bankruptcy into the legislation as soon as possible, can these problems be solved. Through the research and analysis of the personal bankruptcy legal system literature, this paper analyzes the construction of the personal bankruptcy legal system in China on the basis of the comprehensive foreign legislative experie
