摘要 摘 要 正当防卫制度属于我国法律中对遭受不法侵害给予私力救济的关键性法律措施，同 时正当防卫制度也属于我国法律制度里面十分关键的构成部分。我国 《刑法》第20条 规定： “为了使国家、公共利益、本人或者他人的人身、财产和其他权利免受正在进行 的不法侵害，而采取的制止不法侵害的行为，对不法侵害人造成损害的，属于正当防 卫，不负刑事责任。”尽管在我国刑法中明确规定了正当防卫制度，但对其构成要件的 实际理解和掌握却并不统一，从而导致在实践中对正当防卫成立与否存在很多困难和争 议。为更好的从立法目的及立法欲保护的法益角度完善这一法律制度，对正当防卫构成 要件之防卫时间和防卫限度的研究是十分必要的。以引起社会广泛关注的昆山于海明反 杀刘某案的司法处理为例展开研究，通过对案例分析并结合正当防卫理论，就正当防卫 司法认定中的时间标准、限度标准两个问题进行了探讨。根据目前我国正当防卫法律制 度在防卫时间与防卫限度认定上存在的一些不足，进而提出了改进完善正当防卫时间认 定标准与限度认定标准的建议，以期为我国正方防卫制度的完善有所裨益。 关键词 正当防卫；司法认定；防卫时间；防卫限度 - -I 哈尔滨商业大学硕士学位论文 Abstract The system of justifiable defense is a key legal measure to provide private remedy for illegal infringement in our countrys laws, and it is also a key component of our countrys legal system.Article 20 of Penal Code of our country stipulates: anyone who takes an action to stop an unlawful infringement in order toprotect the state,public interests,or hisor her own or another persons rights of person, property or other rights from the ongoing unlawful infringement,thuscausing damagetotheunlawful infringer,isacting injustifiable defense and shall not bear criminal responsibility.Although the system of justifiable defense is clearly stipulated in the penal code of our country, the actual understanding and mastery of its constituent elements are not unified, which leads to many difficulties and disputes over the establishment of justifiable defense in practice.
