PAGE 12 我国食品安全风险行政规制研究 摘 要 食品安全风险行政规制承载着一个国家的风险意识、制度趋势和治理理念，反映着一个国家的风险治理能力。当前，我国在经济发展的推动之下，我国的食品安全风险行政规制将面临许多挑战，一些不确定性风险也渐渐显露。当今世界，全球化日渐加深，国家间的食品安全风险规制经验交流活动日益频繁，形成了以“问题-原因-对策”为模式的风险规制思路。因此，对于我国食品安全风险规制较为滞后的现状，我国可以借鉴域外风险规制经验，针对我国食品安全风险规制预警制度不健全、规制措施缺乏体系性、缺少风险规制的后续保障等问题，在风险预警制度方面：健全食品安全风险信息公开制度、建立多元主体参与的独立风险评估体系；在规范风险规制措施方面：在食品安全标准体系中，引入严格责任、完善食品召回制度，设立事后风险考验期、改革风险规制执法机构设置；在机构体系及后续保障方面：建立风险有效举报的奖励体系、改进食品安全行政问责制度、建立食品安全责任保险制度，逐步解决食品安全风险规制问题，为“舌尖上的安全”提供保障。 关键词：食品安全；风险规制；食品风险考验期；严格责任 Study on Administrative Regulation of Food Safety Risk in China Abstract The administrative regulation of food safety risk bears the sense of risk, system trend and governance concept of a country, and reflects the risk management ability of a country. At present, Chinas economic development in the push, Chinas food safety risk administrative regulations will face many challenges.Some uncertain risks are gradually revealed. In todays world, globalization is deepening, and food safety risk regulation and exchange of experience among countries have become increasingly frequent, thus forming a Problem-Reason-Countermeasures model of risk regulation. Therefore, the status quo for the risk regulation of food safety in China is lagging behind, our country can learn from foreign experience in risk regulation.For Chinas food safety regulation risk early warning system is not perfect, regulatory measures, lack of system, lack of risk regulation of the subsequent security and other issues, so in the risk warning system level: to improve the food safety risk information disclosure system and the establishment of an independent risk assessment system of multiple subjects involved in the regulation of risk;In the regulation measures level: in the food safety standard system, introduce strict responsibility, improve the food recall system, set up after the test period, the risk of risk regulation reform of law enforcement agencies; in the institutional system and follow-up to ensure effective reportin
