本科生毕业论文(设计) 题目 自动驾驶汽车交通事故问题责任研究 院 (系) 专 业 法学院 班 级 学 号 学生姓名 指导教师及职称 定稿日期： 年 月 日 摘 要 1965年“人工智能”概念在美国达特茅斯学院的会议上首次提出，自动驾驶汽车正是以该技术为依托进行自动驾驶，其具备自主判断、自主决策等功能的新型机动车。按照其智能化程度、自动化水平的不同，可分为四个无人驾驶的阶段：驾驶辅助、部分自动化、高度自动化、完全自动化。自动驾驶汽车的出现通过改变汽车的基本使用方式，协助预防交通事故，将人们从大量的驾车时间中解放出来， 随着人工智能技术的迅速发展，自动驾驶汽车被越来越多的人所接受，对于具有自主性的自动驾驶汽车而言，如何认识自动驾驶汽车的自主性，人工智能的自主性是否足够被赋予法律地位被认定为法律主体。自动驾驶技术在为人们生活带来便利的同时，随之而来的是侵权法上责任主体、责任构成、责任承担等多方面的问题。 关键词：自动驾驶汽车，侵权责任法，机动车交通肇事责任，产品责任 ABSTRACT In 1965, the concept of artificial intelligence was first proposed at a meeting at Dartmouth College in the United States. Autonomous vehicles rely on this technology to drive autonomously. They are a new type of vehicle with functions such as autonomous judgment and autonomous decision-making. According to its degree of intelligence and automation, it can be divided into four stages of unmanned driving: driving assistance, partial automation, high automation, and complete automation. The emergence of self-driving cars helps prevent traffic accidents by changing the basic use of cars, freeing people from a lot of driving time. With the rapid development of artificial intelligence technology, self-driving cars are accepted by more and more people For self-driving cars with autonomy, how to recognize the autonomy of self-driving cars and whether the autonomy of artificial intelligence is sufficient to be given legal status to be recognized as a legal subject. While self-driving technology brings convenience to peoples lives, there are many problems in tort law, such as the subject of liability, the structure of liability, and the assumption of liability.
