摘 要 南海是我国海上战略的重要支点，其具有丰富的海洋资源，也成为周边国 家不断侵扰的对象，如何维护南海权益成为我国急需解决的问题。本文主要以 文献研究法搜集我国南海的发展历程，明确南海权益的范围，以此为我国南海 合法权益提供历史性和法理性证据。同时，本文呈现了我国与菲律宾、越南等 国的南海争端、国际方面对南海基准线——九段线的质疑和挑战以及国内对南 海维权不足现状，表明了南海维权方面受到多方面的挑战。在此基础上，本文 从多个角度提出南海维权策略，我国可以优先通过外交手段与他国沟通，利用 国际法维护自身的合法权益，也应加强国内海洋法律建设，为南海维权提供坚 实的法律后盾。在维权的同时，我国还应注重对南海的管理和开发，以三沙市 为代表，合理协调和规划南海的行政管理，主张搁置争议，在保护生态环境的 前提下共同开发南海资源。南海维权势在必行，中国需要通过多种手段维护南 海的合法权益，保障我国的海防安全。 关键词：南海；海洋权益；维权现状；维权策略 Abstract The south China sea is Chinas maritime strategy important fulcrum, it has rich Marine resources, also become the object of surrounding countries harass, how to maintain the rights and interests of the south China sea to become our country urgently needs to solve the problem. This paper mainly collects the development history of the south China sea by the method of literature research, clarifies the scope of rights and interests in the south China sea, so as to provide historical and legal evidence for the legitimate rights and interests in the south China sea.
