我国房地产统一登记制度研究 中文摘要 房地产是一项事关国计民生的重要支柱产业，是人民大众赖以生活、生存和发展的 根基。近年来，我国房地产行业发展迅速，房地产登记制度发挥着越来越重要的作用， 特别是在维护房地产经济发展秩序，保障房地产交易安全、规范等方面所起的作用尤为 明显。房地产登记是指房地产管理部门依其职权对房地产权利人合法土地使用权、房屋 所有权以及由上述权利产生的抵押、租赁等房地产其余权利的登记发证行为。房地产登 记是不动产登记的一部分，由土地登记和房屋登记组成。 全文结构拟分为三大章。 第一章“房地产登记制度的概念和内容”，本章主要详述房地产登记的概念和程序。 第二章“我国房地产登记制度存在的问题”，本章从房地产登记制度在法律法规依据 方面的不完善、房地产登记机关设置方面的不统一、登记效力方面的不明确以及审查义 务方面的不公开等方面进行分析，并浅析我国房地产登记制度存在缺陷的原因。 第三章“完善我国房地产登记制度的基本对策”，本章针对房地产登记制度存在的缺 陷问题，结合我国国情，提出相关对策及其建议，从理论层面积极建言构建科学、完 善、规范的房地产登记制度。最后总结对房地产统一登记制度研究的一些心得和展望。 [关键词]：房地产登记；存在问题；完善意见 Research on the unified registration system of real estate in China Abstract Real estate is an important pillar industry that affects the national economy and the peoples livelihood. It is the foundation of the peoples life, survival and development.In recent years, Chinas real estate industry has developed rapidly, and the real estate registration system has played an increasingly important role, especially in the maintenance of real estate economic development order, ensuring the security and regulation of real estate transactions.Real estate registration refers to the registration and issuance of real estate rights by the real estate management department in accordance with its authority over the legal land use rights, house ownership, and other rights of real estate such as mortgages and leases generated by the above rights.
