Key Words: artel; mode of lawmaking; chinese lawmaking 一、引言 合作社是商品经济发展到一定历史阶段的产物，是市场经济中不可缺少的活跃主体?目前，合作社对于发展本国经济?应对经济全球化挑战发挥着日益重要的作用，世界上大多数国家和地区的人们都享受到了合作社的好处?国际合作社联盟(International Cooperative Alliance，简称ICA)1995年代表大会通过的《关于合作社界定的声明》(Statement on the Cooperative Identity，以下简称《声明》)中将合作社定义为:“合作社是自愿联合起来的人们通过共同所有与民主管理的组织以实现其共同的经济?社会与文化目标及需求的自治联合体?”(“A cooperative is an autonomoue association of peo united voluntarily to meet their common economic，social， and cultural needs and aspiratio through a jointly-owned and democratically controlled enterprise.”)该《声明》关于合作社定义?合作社价值和合作社原则的内容， 得到了2002年6月20日第九十届国际劳工组织(ILO)大会通过的《合作社促进建议书》(Promotion of Cooperatives Recommendation，2002，以下简称《建议书》)的认可?《建议书》指出:“
