论知识产权的保护 --以比较法为视角 内 容 摘 要 在面临如今经济全球化的发展趋势之下，我国知识产权保护这方面的工作就 显得尤为重要。不可否认的是，中国知识产权保护问题在改革开放后取得了一定 的成就，但是新时代带来的新的挑战依旧艰巨。虽然在我国目前的知识产权保护 制度中，知识产权运用水平明显提高，知识产权保护机制不断完善，知识产权文 化氛围逐渐形成。但是在知识产权立法、执法、司法以及普法的道路上依然任重 而道远。如何提高知识产权立法质量、提高知识产权执法效率、加强知识产权的 宣传教育是当前亟待解决的任务。为此，本文仅通过比较法的视角浅析国内与国 外的知识产权保护的区别，并从中发现各自的优点，为我国所用、为我国所改进， 通过加强对知识产权的保护不断激发我国创新的活力和增长点。 关键词：知识产权保护制度；国内知识产权保护；国外知识产权保护； I On the Protection of Intellectual Property Rights --from the Perspective of Comparative Law Abstract In the face of the development trend of economic globalization, the protection of intellectual property in China is particularly important. It is undeniable that Chinas intellectual property protection has made some achievements after the reform and opening up, but the new challenges brought by the new era are still arduous. Although in the current intellectual property protection system in China, the level of intellectual property application has been significantly improved, the mechanism of intellectual property protection has been continuously improved, and the cultural atmosphere of intellectual property has gradually formed. But there is still a long way to go in the way of intellectual property legislation, law enforcement, justice and law popularization. How to improve the quality of intellectual property legislation, improve the efficiency of intellectual property law enforcement, and strengthen the publicity and education of intellectual property are urgent tasks.
