论组织考试作弊罪

摘要：随着社会人才资源需求的不断增长，考试已经成为当今社会分配人才资源的至为重要的工具，考试成为了现代社会生活中越来越重要的一部分。我国每年都在进行着各种各样的考试，在考试过程中发生作弊行为的现象已经司空见惯了，考试作弊的数量也日益庞大，现在我国的考试作弊现象表现出来的特点就是参与作弊行为的人数越来越多且系统性操作越来越明显。2015年我国《刑法修正案（九）》对组织考试作弊的行为正式在法律上作出了规定，2019年《最高人民法院、最高人民检察院关于办理组织考试作弊等刑事案件适用法律若干问题的解释》又进一步为组织考试作弊罪的准确理解和适用法律提供了明确的界定标准。因此，本文将通过对组织考试作弊罪进行系统的分析，希望在具体实务中能够有所帮助。全文将分为四个部分对此展开论述。

Abstract:Withthecontinuousgrowthofthedemandforhumanresources,theexaminationhasbecomethemostimportanttooltoallocatehumanresourcesintodayssociety,andtheexaminationhasbecomeanincreasinglyimportantpartofmodernsociallife.Everyyearinourcountryiscarryingoutavarietyofexaminations,intheexaminationprocessofcheatingphenomenonhasbecomecommon,thenumberofcheatingintheexamisalsoincreasinglylarge,nowourcountrysexaminationcheatingphenomenonischaracterizedbyanincreasingnumberofpeopleinvolvedincheatingandmoreandmoreobvioussystematicoperation.OnNovember1,2015,criminallawamendment(9)formalimplementation,theamendmenttocheatingintheexamorganizationbehaviortomakeaprovisioninthelaw,fillinthelegislationofourcountrytocheatintheexamorganizationcrimeinthecriminallawontheblank,onSeptember4,2019formallyimplementedtheSupremePeoplesCourt,theSupremePeoplesProcuratorateaboutcheatingintheexamfororganizationssuchasthecriminalcasetoexplainsomeissuesofapplicablelawfurthercheatingintheexamfortheorganizationcrimeintheaccurateunderstandingandapplicationoflawprovidesacleardefinitionofstandards.Therefore,thispaperwillcarryonthesystematicanalysistothecrimeoforganizingcheatingintheexamination,hopingtobehelpfulintheconcretepractice.Thethesiswillbedividedintofourparts.
