1.ApplicationforRectification重整申请
（1）Adebtororcreditormayapplydirectlywiththepeoplescourtfor
rectificationonthedebtor.人或者债权人可以直接向申请对人进行
重整。
（2）Whereanycreditorappliesforbankruptcyliquidationagainstitsdebtor,
afterthepeoplescourtacceptstheapplicationforbankruptcyandbeforethe
debtorisannouncedbankruptcythedebtororitscapitalcontributorwhose
capitalcontributionmakesup1/10ormoreofthedebtorsregisteredcapital
mayapplywiththepeoplescourtforrectification.债权人申请对人进行

2.bindingforacceptinganapplicationforrectification
（1）Duringtheperiodofrectification,adebtormay,afterfilingan

期间，经人申请，批准，人可以在管理人的监督下自行管产和营业事
务。

custodianthathastakenovertheassetsandbusinessoperationshalldeliver
theassetsandbusinessoperationtothedebtorinaccordancewiththeprovisions
ofthepresentlaw,andthebankruptcycustodiansfunctionsanddutiesas
prescribedhereinshallbeexercisedbythedebtor.有前款规定情形的，依照本
定已接管人财产和营业事务的管理人应当向人移交财产和营业事务，本定的管
理人的职权由人行使。
（2）Duringtheperiodofrectification,therighttomakeguaranteeonthe
particularassetsofadebtorshallbesuspended.However,inthecaseofpossible
damageorsignificantdecreaseofvalue,whichmayinjuretheguarantorsright
