第一章总则
Article1ThisLawisformulatedinaccordancewiththe
Constitutioninordertoprotectthelegitimaterightsandinterestsof
patentees,toencourageinventionandinnovation,topromotethe
applicationandpopularizationofinventions,andtocontributeto
thedevelopmentofthesocialistmarketeconomy.
第一条为了保护专利权人的合法权益，鼓励发明创造，推动
发明的应用和推广，有利于社会主义市场经济的发展，根据宪
法制定本法。
recognizedexclusiverightgrantedtoaninventororcreatorforhis
orherinvention-creationinthefieldsoftechnologyanddesign,for
whichapatentapplicationhasbeenfiledandapatenthasbeen
granted.
第二条本法所称专利，是指依照本法规定，由国家给予发明
人或设计人在技术和设计领域内，因其提出专利申请并经审查
合格后而享有的法律保护的排他权利。

principlesofequity,convenience,andeffectiveness.
第三条专利的授予和保护必须遵循公平、便利、有效的原则。

protectstheintellectualpropertyrightsassociatedwithpatentsin
accordancewiththelaw.TheStatepromotesthetransformationof
scientificandtechnologicalachievementsintopractical
applications,andsupportstheestablishmentofapatentsystemthat
isconducivetothedevelopmentofthesocialistmarketeconomy.
第四条国家鼓励发明创造，依法保护与专利有关的知识产权，
推动科技成果的转化为实际生产力，支持建立适应社会主义市
场经济发展的专利制度。

第二章可专利发明创造
Article5Anyinventionorcreationrelatedtoaproductorprocess
inthefieldsoftechnologyordesignshallbepatentable,provided
thatitisnovel,involvesaninventivestep,andhasindustrial
applicability.
第五条在技术和设计领域内，任何关于产品或者工艺的发明
创造，符合新颖性、创造性和实用性的，均可以申请专利。
Article6Thefollowingitemsshallnotbegrantedpatents:
(1)scientificdiscoveries;
(2)rulesandmethodsformentalactivities;
(3)methodsforthediagnosisortreatmentofdiseases;
(4)animalorplantvarieties;
(5)substancesobtainedbyusingnuclearre
