ABSTRACT

OntheInformationStructureandItsLinguisticRealizationinLegalDiscourse:A

Chinese-EnglishContrastiveDiscourseAnalysisisanEnglishmonographonforensic

linguistics.Thismonographdiscussestherulesofinformationstructureandlinguistic

realizationinEnglishandChineselegaldiscoursesbycontrastiveanalysisbasedon

corpusstudies.Chapter5:LegalSystemisthesourcetextofthetask.Thesourcetext,

anacademiclegalscholarlytextofmainlydescriptivebutalsoprescriptivefunction,

mainlyexplainshowlegalsystemsinfluenceinformationflowandconfiguration.Itcan

deepenlegaltranslators’understandingofthedifferencesbetweenChineselawand

commonlawandfurtherguidetheirtranslationpractice.

Thetranslationtaskisgroundedintheprincipleof“strictaccuracy,clarityand

concision,consistency,linguisticandstylisticstandardization”,andthepurposeof

achieving“communicationwithinthemechanismofthelaw”.Inthereport,itis

discoveredthatlegaltermsprevailatthelexicallevel,andpassivevoiceandattributive

clausesareprevalentatthesyntacticallevel.Thus,itissignificanttolookup

authoritativedictionariesandtranslatefromtheperspectivesoflanguage,knowledge

andcommunication.Inaddition,voicechangeandtechniquesindealingwith

attributiveclauses,suchaspreposing,coordinationandtransformation,areusedinthe

task.What’smore,cohesionandpragmaticenrichmentarethefocusatthetextualand

pragmaticlevel,whichcanachievethecommunicativepurposeofthetargettext.
