;一、合同订立的程序（Procedureofcontractconclusion）

与其他合同的订立程序相同。建设工程合同的订立也要采取要约和承诺方式。根据《中华人民共和国招标投标法》对招标、投标的规定,招标、投标、中标的过程实质就是要约、承诺的一种具体方式。招标人通过媒体发布招标公告,或向符合条件的投标人发出招标文件,为要约邀请;投标人根据招标文件内容在约定的期限内向招标人提交投标文件,为要约;
