建设工程施工招标应该具备的条件包括以下几项:

招标人已经依法成立;初步设计及概算应当履行审批手续的,已经批准;招标范围、招标方式和招标组织形式等应当履行核准手续的,已经核准;有相应资金或资金来源已经落实;有招标所需的设计图纸及技术资料。这些条件和要求,一方面是从法律上保证了项目和项目法人的合法化,另一方面,也从技术和经济上为项目的顺利实施提供了支持和保障。

从理论上讲,在市场经济条件下,建设工程项目是否采用招标的方式确定承包人,业主有着完全的决定权;采用何种方式进行招标,业主也有着完全的决定权。但是为了保证公共利益,各国的法律都规定了有政府资金投资的公共项目(包括部分投资的项目或全部投资的项目)、涉及公共利益的其他资金投资项目、投资额在一定额度之上时,要采用招标的方式进行采购。对此我国也有详细的规定。

(1)大型基础设施、公用事业等关系社会公共利益、公众安全的项目。

(2)全部或者部分使用国有资金投资或者国家融资的项目。
