ABSTRACT

Socialplatformshavebecomeanindispensablepartofthepublicslifeby

buildingatripartiterelationshipofcountry-platform-societyandprovidinga

convenientbridgeforpeopletocommunicatewitheachother.Butsocial

platformsforceuserstoacceptplatformdisclaimersandarbitrarytermination

ofservice,arbitrarilytakecovertmeasurestoreducethevisibilityofuser

content,andadjudicateontheirownmerits.Socialplatformscreateprivate

powerthroughself-empowerment,whichresultsinindulgenceinthe

disseminationofillegalcontentandthedetrimentofusers’rightsandinterests,

buttheylacktheincentivetoimprovetheircontentmanagement,coupledwith

thepublicnatureofitscontentmanagementpracticesinvolvingusersfreedom

ofexpressionandaccesstoinformation.whichthereforeexternalregulationis

urgentlyneededtoregulatetheircontentmanagement.

ThispaperisdedicatedtothestudyofU.S.andEuropeanregulatory

modelsofsocialplatforms’contentmoderationandtheirrespectivestrengths

andweaknesses.TheUnitedStateshasadoptedanexpostregulatorymodel

forsocialplatforms’contentmoderationthroughtheCommunicationsDecency

Act(CDA)andtheDigitalMillenniumCopyrightAct(DMCA).Withthejudiciary

astheusualremedialauthority,andplatformsmainlyholdingliablefortort

liabilitynorms,expostregulationfocusesonremediesforviolationsofthelaw,

whichischaracterisedbylaxregulation.TheU.S.expostregulationreduces

theburdenofcontentmanagementonsocialplatforms,butfocusesonthe

judgementofsubstantivevalue,dwellsonthedifferencebetweentherolesof

publishersanddistributors,andlimitsitselftocase-by-caseremediesthat
