ABSTRACT

Recognitionandenforcementofforeigncourtjudgmentsisthelastand

mostcriticalstageininternationalcivilproceedingsandconstitutesthemain

contentoftheInternationalCivilProcedureLaw.ChinasCivilProcedureLaw

of2023amendedthesystemofrecognizingandenforcingforeigncourt

judgments,whichtoalargeextentremediedtheshortcomings.However,there

isstillroomforfurtherimprovementinChinassystemontherecognitionand

enforcementofforeigncourtjudgments.Drawonthematureandadvanced

experienceofothercountrieswhilefullyintegratingitsownreality.Japanisthe

firstcountrytoprovidefortherecognitionandenforcementofforeigncourt

judgments,absorbingtheexperienceofGermany,therepresentativeofcivil

lawcountries,therearealargenumberoftheoreticaldoctrineandpractical

jurisprudence.ChinaandJapanarebothcivillawcountries,inviewofthis,this

studyfocusesonJapansrecognitionandenforcementofforeigncourt

judgmentsandpractice,aimingtoprovidereferenceforChinaslegislationand

judicialpracticeintherecognitionandenforcementofforeigncourtjudgments,

andexpecttobeabletoproviderelevantguidanceandassistance.

Thispaperappliesthenormativeanalysismethod,legalhermeneutics

methodandcaseanalysismethodtostudyindepththeproblemsexistingin

Chinassystemofrecognizingandenforcingforeigncourtjudgments,and

extractstheexperiencesuggestionswhichareusefulforChinasrelevant

systembycomparingandanalyzingJapanstheoriesandpracticesinthe

systemofrecognizingandenforcingforeigncourtjudgments.

ChapterI,throughtheanalysisofthecurrentsituationofthesystemof

recognitionandenforcementofforeigncourtjudgmentsinChina,putsforward

theexistingproblems.ThispaperpointsoutthatalthoughChinasCivil
