建设工程索赔的方法

;一、索赔意向通知（Noticeofintenttoclaim）

在工程实施过程中发生索赔事件以后,或者承包人发现索赔机会,首先要提出索赔意向,即在合同规定时间内将索赔意向用书面形式及时通知发包人或者工程师,向对方表明索赔愿望、要求或者声明保留索赔权利,这是索赔工作程序的第一步。

索赔意向通知要简明扼要地说明索赔事由发生的时间、地点、简单事实情况描述和发展动态、索赔依据和理由、索赔事件的不利影响等。

(2)分析干扰事件产生的原因,划清各方责任,确定索赔根据。

(3)损失或损害调查分析与计算,确定工期索赔和费用索赔值。

(4)搜集证据,获得充分而有效的各种证据。

提出索赔的一方应该在合同规定的时限内向对方提交正式的书面索赔文件。承包人必须在发出索赔意向通知后的28天内或经过工程师同意的其他合理时间内向工程师提交一份详细的索赔文件和有关资料。如果干扰事件对工程的影响持续时间长,承包人则应按工程师要求的合理间隔(一般为28天),提交中间索赔报告,并在干扰事件影响结束后的28天内提交一份最终索赔报告。否则将失去就该事件请求补偿的索赔权利。
